Please read these terms carefully before using DAASIL. By using our platform, you agree to be bound by the following terms.
1. Acceptance of Terms
By accessing or using DAASIL ("the Platform"), you agree to be bound by these Terms and Conditions. If you do not agree to all the terms and conditions, you must not use our Platform. These terms apply to all users including business owners, staff members, and administrators who access DAASIL.
2. Description of Service
DAASIL is a business CRM platform that enables business owners and administrators to manage customers, staff, plans, finances, marketing, communication, and generate reports. The Platform is provided on a subscription basis. Features may vary by product and plan as detailed on our Pricing page.
3. Account Registration
To use DAASIL, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account. You must immediately notify DAASIL of any unauthorized use of your account.
4. Subscription and Payments
DAASIL offers subscription plans billed monthly or annually. Payment is due at the beginning of each billing cycle. All fees are non-refundable except as required by law or as explicitly stated in our refund policy. We reserve the right to change our pricing with 30 days advance notice. Continued use of the Platform after a price change constitutes acceptance of the new pricing.
5. Data Privacy and Security
We take the privacy and security of your data seriously. DAASIL collects and processes personal data in accordance with our Privacy Policy. You retain ownership of all data you input into the Platform. We implement industry-standard security measures including encryption at rest and in transit. We do not sell, rent, or share your business's customer data with third parties without your explicit consent.
6. Customer Data Responsibility
As a business owner using DAASIL, you are responsible for obtaining appropriate consent from your customers to store and process their personal information on the Platform. You must comply with all applicable data protection laws in your jurisdiction, including the Information Technology Act and relevant regulations in India. DAASIL acts as a data processor on your behalf.
7. Acceptable Use
You agree not to use DAASIL for any unlawful purpose or in any way that could harm the Platform, its users, or third parties. Prohibited activities include: attempting to gain unauthorized access to any part of the Platform; distributing malware or harmful code; scraping or automated data extraction; impersonating other users or entities; using the Platform to send unsolicited communications; or violating any applicable laws or regulations.
8. Intellectual Property
DAASIL and its original content, features, and functionality are and will remain the exclusive property of DAASIL and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of DAASIL. You are granted a limited, non-exclusive, non-transferable license to use the Platform for your internal business purposes during your subscription period.
9. Uptime and Service Availability
DAASIL strives to maintain 99.9% uptime. Scheduled maintenance will be communicated in advance whenever possible. We are not liable for service interruptions due to factors outside our reasonable control including internet outages, force majeure events, or third-party infrastructure failures. We will make reasonable efforts to restore service as quickly as possible in the event of an unplanned outage.
10. Limitation of Liability
To the maximum extent permitted by applicable law, DAASIL shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Platform. Our total liability to you for any claims arising under these Terms shall not exceed the total amount you paid to DAASIL in the three months preceding the claim.
11. Termination
Either party may terminate this agreement at any time. You may cancel your subscription from your account settings. Upon termination, your access to the Platform will cease at the end of your current billing period. We may terminate or suspend your account immediately, without prior notice, if you breach these Terms. Upon termination, you may request an export of your data within 30 days, after which your data may be permanently deleted.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes through the Platform or via email. Your continued use of DAASIL after changes become effective constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India. You waive any objection to such jurisdiction and venue.
